Hirarki Norma dan Proses Pembentukan Hukum

Deskripsi Kelsen mengenai proses hukum sebagai sebuah hirarki norma-norma, keberlakuan setiap norma (terlepas dari norma dasar) bersandar pada norma yang lebih tinggi, dan setiap level dalam hirarki yang mewakili pergerakan dari keumuman utuh menjadi individualisasi yang semakin meningkat, kadang kala disalahpahami bahwa interpretasi dan aplikasi aturan umum adalah sebuah karakter mekanik semata. Hal ini sangatlah jauh dari pandangan Kelsen. Sebaliknya, Kelsen menunjukkan bahwa, meskipun hukum memiliki keunikannya sendiri dalam mengatur hasil ciptaannya, norma yang lebih tinggi dapat menentukan ciptaan dan konten normal in hanya pada level tertentu. Sejauh terdapat diskresi atau pun pilihan terhadap aturan yang diaplikasikan, fungsi norma dalam menciptakan berkaitan dengan karakter politis. Hal ini tampak jelas dalam cara Mahkamah Agung Amerika Serikat menginterpretasikan Undang-Undang, namun ini sama saja dengan aplikasi hukum oleh pihak yang berwenang. Dan fungsinya tidak berhenti hanya pada tataran absah saja sebab hal ini masih berada dalam kerangka norma-norma.  
Kelsen tidak meniadakan nilai sosiologi hukum. Sosiologi hukum berdiri berdampingan dengan yurisprudensi normatif dan tak dapat saling menggantikan. Yurisprudensi normatif berkaitan dengan keabsahan dan sosiologi hukum berkaitan dengan keampuhan, namun keduanya saling terhubung, sebab sosiologi hukum mengandaikan konsep normatif hukum. Namun Kelsen menarik garis perbedaan antara peran ilmuwan hukum dengan pihak berwenang yang menciptakan hukum, misalnya hakim. Ilmuwan hukum hanya dapat mendeskripsikan namun tidak menegakkan, dan, oleh sebab itu, mereka tidak dapat melaksanakan hal-hal yang dapat dilakukan oleh pihak yang kedua. Ilmuwan hukum harus menerima segala keputusan sebagai sesuatu yang sah sebab hal tersebut berada di luar kuasanya untuk menyatakan apakah hal tersebut berada dalam kerangka norma umum yang sedang dipertanyakan. Dan meskipun mereka dapat memberikan kemungkinan interpretasi mereka harus menyerahkan hal tersebut kepada pihak yang berwenang dalam menciptakan hukum untuk mengambil keputusan, sebab mencoba mempengaruhi wewenang ini berarti melaksanakan fungsi politis dan bukannya fungsi hukum. Kelihatannya dalam hal ini tindak penolakan ikut terlibat dalam porsi ilmu hukum yang tampaknya sulit merelakan, dan nampaknya menyebabkan para penasihat hukum berdebat mengenai sebuah kasus sebagai potisi, daripada sebagai pengacara.

Indonesian Certified and Sworn Translator

In Indonesia, sworn translator or also often called certified or authorized translator refers to a person having attended and passed legal field translator qualification examination organized by the Translators Development Program of the International Languages Institute of the Faculty of Cultural Sciences of the University of Indonesia. After being certified to have passed, he/she will then be taken oath by the Governor of DKI Jakarta.

Whereas the content of the oath is as follows:

That I, to be assigned as a translator, from …………… (language) into ……………… (language), either directly or indirectly, in any name or reason whatsoever, do not give anything, or promise to give something to anyone whomsoever;

That I will fulfill such duties of mine truthfully and in the shortest time possible and as fast as possible;

That I will comply with the righteous truth, translate letters presented to me, without adding or reducing the meaning thereof;

That I, in calculating my income, will be subject to the provisions made or will be made by the government;

That I will not announce all things which must be kept confidential in my duty;

That I, in order to do something or not do anything, for any reasons whatsoever, which is in conflict with this oath, will not receive from anyone, either directly or indirectly, a promise or gift.

Documents Translation and Certification by a Sworn Translator

Some documents (especially documents that will be brought abroad) such as academic, personal, and litigation documents are usually required to pass a number of bureaucracies covering Embassies, Department of Justice, and Department of Foreign Affairs.

In order to be able to be legalized, such documents should be firstly translated into the national language of the country of destination and sealed and signed by a sworn translator.

Example 1
Requirements for Document Legalization at the Ministry of Justice and Human Rights

1. Legalization application letter signed by the applicant.

2. Photocopy of KTP (Resident Identity Card) of the applicant.

3. Photocopy of the document to be legalized.

4. If the document to be legalized is in the form of translated version from Indonesian language into a foreign language, photocopy of the Indonesian version of the document should be enclosed.

5. If the document to be legalized is a corporate document, Power of Attorney from Board of Directors and photocopy of KTP (Resident Identity Card) of the principal and the proxy should be enclosed.

6. Rp 6,000 stamp duty for each document to be legalized.

7. Receipt of payment of Non-Tax State Revenue (PNBP).

Example 2
Requirements for Document Legalization at the Ministry of Foreign Affairs

1. Submitting application of legalization accompanied with the reason for the use of the relevant letter/document abroad.

2. The translation of the letter/document by an authorized translator into the language of the country of destination.

3. Photocopy of the letter/document that has been legalized by the Ministry of Justice and Human Rights.

4. Rp 6,000 stamp duty for each letter/document to be legalized.
